These Terms of Service ("Terms") govern your use of the BruhForge MarTech platform ("Platform") operated by BruhLogic LLC. By signing up for or using the Platform, you agree to these Terms.
1. Overview
BruhForge MarTech is a white-label marketing technology platform that provides CRM, marketing automation, AI-powered communications, lead capture, review management, and related services to small and mid-size businesses ("Clients"). The Platform is accessed through your branded dashboard at martech.bruhlogic.com or a custom domain configured for your account.
2. Eligibility
You must be at least 18 years old and have the authority to bind the business entity you represent. By using the Platform, you represent that you meet these requirements.
3. Account Registration and Security
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for all activity that occurs under your account.
- You must notify us immediately via email if you become aware of any unauthorized access.
- We reserve the right to suspend or terminate accounts that violate these Terms.
4. Service Plans and Pricing
4.1 Plans

Additional services (e.g., additional Vapi voice AI agents at $500/month each) may be added to any plan.
4.2 Setup Fees
- Setup fees are due at the time of purchase and are non-refundable once onboarding has begun.
- Onboarding is considered to have begun once you receive access to the onboarding form or your sub-account is provisioned, whichever comes first.
4.3 Monthly Fees
- Monthly subscription fees are billed on the same day each month, beginning 30 days after your account goes live (or 30 days after your setup fee payment, whichever is earlier).
- All fees are in U.S. dollars.
5. Payment Terms
- Payments are processed through Stripe. By providing payment information, you authorize us to charge the applicable fees.
- If a payment fails, we will attempt to collect payment again. If payment is not received within 7 days of the due date, your account may be suspended.
- Suspended accounts will have automated workflows paused. Your data will be retained for 30 days. After 30 days of non-payment, we reserve the right to terminate your account and delete associated data.
6. Cancellation and Refunds
6.1 Cancellation
- You may cancel your subscription at any time by emailing us with at least 15 days' written notice before your next billing date.
- Cancellation takes effect at the end of the current billing period. You will continue to have access until that date.
- There is no early termination fee.
6.2 Refunds
- Setup fees are non-refundable once onboarding has begun.
- Monthly fees are non-refundable for the current billing period. If you cancel mid-cycle, you retain access through the end of that cycle.
- In the event of a Platform outage exceeding 48 continuous hours due to our fault (not third-party service outages), you may request a pro-rated credit for the affected period.
6.3 Data After Cancellation
- Upon cancellation, you may request an export of your data (contacts, leads, communication history) within 30 days.
- After 30 days, your sub-account and associated data will be permanently deleted.
7. Acceptable Use
You agree not to use the Platform to:
- Send unsolicited messages (spam), including SMS, email, or voice calls, to contacts who have not provided consent.
- Violate the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, or any other applicable communications law.
- Transmit malware, viruses, or any harmful code.
- Impersonate another person or entity.
- Use the Platform for any illegal purpose.
- Attempt to access other clients' data or sub-accounts.
- Resell, sublicense, or redistribute the Platform or its features without our written consent.
- Exceed reasonable usage limits or use the Platform in a way that degrades performance for other clients.
We reserve the right to suspend or terminate your account immediately if you violate this section.
8. Intellectual Property
8.1 Our Property
The Platform, including its software, design, documentation, workflows, AI models, and branding, is owned by BruhLogic LLC. You are granted a limited, non-exclusive, non-transferable license to use the Platform for your business operations during your active subscription.
8.2 Your Content
You retain ownership of all content you upload to the Platform (logos, brand assets, business information, contact lists). By uploading content, you grant us a limited license to use it solely for the purpose of providing the Platform's services to you.
8.3 AI-Generated Content
Content generated by the Platform's AI features (SMS templates, email drafts, voice agent scripts) is provided as a tool for your use. You are responsible for reviewing and approving all AI-generated content before it is sent to your customers.
9. Third-Party Services
The Platform integrates with third-party services including but not limited to:
- GoHighLevel (CRM and automation)
- Stripe (payments)
- Vapi.ai (voice AI)
- Google Business Profile (reviews and local SEO)
- Facebook/Instagram (social media integrations)
Your use of these integrations is subject to each provider's own terms of service. BruhLogic is not responsible for the availability, performance, or policies of third-party services.
10. Service Level Expectations
10.1 Uptime
We target 99.5% monthly uptime for the Platform. This excludes:
- Scheduled maintenance (we will provide 24 hours' notice when possible)
- Third-party service outages (GHL, Stripe, Vapi, etc.)
- Force majeure events
10.2 Support

Support is available via email during business hours (Monday–Friday, 9 AM – 6 PM Central Time), excluding U.S. federal holidays.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- BruhLogic's total liability for any claims arising under these Terms shall not exceed the total fees paid by you in the 3 months preceding the claim.
- BruhLogic is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, lost data, or business interruption.
- BruhLogic is not liable for damages arising from:
- Your failure to comply with TCPA, CAN-SPAM, or other communications laws.
- Actions of your customers or contacts.
- Third-party service outages or changes.
- AI-generated content that you approved and sent without adequate review.
12. Indemnification
You agree to indemnify and hold harmless BruhLogic LLC, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:
- Your use of the Platform.
- Your violation of these Terms.
- Your violation of any applicable law or regulation, including TCPA and CAN-SPAM.
- Content you upload or communications you send through the Platform.
13. Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE." BRUHLOGIC MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not guarantee:
- Specific results from using the Platform (lead volume, revenue, review counts, etc.).
- Uninterrupted or error-free service.
- That AI-generated content will be accurate, appropriate, or effective.
14. Modifications to Terms
We may update these Terms from time to time. We will notify you of material changes by email at least 15 days before they take effect. Your continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
If you do not agree with updated Terms, you may cancel your subscription before the effective date.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of Louisiana, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through:
- Informal resolution: Contact us via email. We will attempt to resolve the dispute within 30 days.
- Binding arbitration: If informal resolution fails, disputes shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. Arbitration shall take place in Louisiana.
- Class action waiver: You agree to resolve disputes individually and waive the right to participate in class actions or class arbitrations.
16. Miscellaneous
- Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and BruhLogic regarding the Platform.
- Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
- Waiver: Our failure to enforce any provision does not constitute a waiver of that provision.
- Assignment: You may not assign your rights under these Terms without our written consent. We may assign our rights in connection with a merger, acquisition, or sale of assets.
